Q. Why would you overpay?
A. Overpayment of sales tax is generally the result of common oversight, where you are paying taxes from which you could be exempt.
Q. Who Qualifies for the exemption?
A. A wide range of businesses such as manufacturers, processors, fabricators, residential, nursing homes, agricultural, and certain non profit organizations qualify for this exemption.
Q. How do you qualify?
A. In the State of Texas, the
predominant use (51% or more) of
natural gas or electricity must be
used for manufacturing, processing,
or fabricating purposes. In
residential use, the majority of
your residents must stay 29 days or
longer or predominantly use the
energy over temporary residents.

Q. What is the fee for the PUUS? (Predominant Utility Usage Study)
A. Upon successful completion
of PUUS, your company will receive a
refund of over paid tax. Our firm is
paid from that claim. In the State
of Texas, you may be entitled to up
to a maximum of four years of
over-paid taxes, depending on how
long your facility has been at it's
present location.
Q. What does it cost not to claim?
A. Unless you have these taxes removed, you will pay them forever, hereby costing your firm a significant amount of money in the long run.
Q. I have facilities in other states as well. Would those facilities qualify for this exemption?
A. It is likely that certain
facilities in other states qualify.
The sales and use tax laws vary from
state to state, as do the
requirements for the exemption and

Q. How long does it take to receive my refund and exemption?
A. Filing for refund and exemption directly with the Utility Provider generally has a 6 to 8 week turn around in most cases.. In the event that the refund and exemption must be filed directly with the state, the process can take longer.
Regardless of weather it must be filed with the State of Texas or with the utlilty provider, we guarantee to expedite your refund and exemption as quickly as possible.
Q. How often do I have to file for this exemption?
A. You file for this exemption one time. The exemption is retroactive for 4 years in the State of Texas, entitling your firm to four years of overpaid taxes. The exemption stays with your company for the life of your business. The only factors that can remove your exemption status are as follows. |

• A change in utility provider
• Any major changes in your facility that would affect predominant use of your
